Terms and conditions

The rules for using this website, and the terms that apply when you engage me for advertising services.

Agreement

By using this website you accept these terms. If you don't agree with them, please don't use the site. Where you engage me for services, a separate written proposal or agreement will set out the specifics, and where the two conflict, that signed agreement takes precedence over this page.

About the business

This site is operated by Raghaw Mishra, trading as Raghaw.Digital, a sole proprietorship based in Lucknow, Uttar Pradesh, India. Contact: raghaw.digital@gmail.com.

Services

I provide paid advertising services, which may include Meta Ads management, Google Ads management, conversion tracking setup, and advertising account audits. The exact scope for any engagement is defined in the proposal agreed before work begins.

Services are delivered with reasonable skill and care, in line with professional standards. Advertising results depend on many factors outside my control — market conditions, competitor activity, platform policy changes, your product, your pricing, and your website. No specific result is guaranteed. See the disclaimer for more on this.

Your responsibilities

  • Provide accurate information about your business, products and objectives
  • Give the access needed to advertising accounts, analytics and websites in a timely way
  • Pay advertising platforms directly for media spend, unless agreed otherwise in writing
  • Ensure your products, services, claims and website comply with applicable law and platform policies
  • Respond to requests for approval, assets or feedback within a reasonable time

Delays caused by missing access, assets or approvals are not treated as a failure to deliver on my side.

Account ownership

Advertising accounts, pixels, tags, audiences and the data within them belong to you and are created under your business wherever possible. On termination, my access is removed and everything stays with you, including campaign history.

Fees and payment

  • Fees are a flat monthly retainer, or a fixed project fee, as set out in your proposal
  • Media spend is separate and paid by you directly to the advertising platforms
  • Retainers are invoiced in advance, at the start of each billing period
  • Payment is due within 7 days of invoice unless agreed otherwise
  • Services may be paused where an invoice remains unpaid for more than 14 days
  • Applicable taxes are added where required by law

Term and termination

Engagements run month to month unless a fixed term is agreed. Either side may end the arrangement by giving 30 days' written notice. Fees for the notice period remain payable, and work already delivered is not refundable. See the refund policy for the detail.

An engagement may be ended immediately, without notice, where there is a serious breach of these terms, a legal or platform-policy risk, or abusive conduct.

Confidentiality

Both sides agree to keep the other's confidential business information private and not to disclose it to third parties, except where disclosure is required by law. This survives the end of the engagement.

Unless you object in writing, I may describe the work in general terms — industry, channel and approach — without naming you or sharing specific figures.

Intellectual property

All content on this website — text, layout, graphics and code — belongs to Raghaw.Digital and may not be copied, republished or reproduced without written permission.

Strategy documents, audits and reports prepared for you become yours on payment. Underlying frameworks, templates, checklists and methods remain mine and may be reused with other clients.

You keep ownership of your brand assets, product images, trademarks and any creative you supply.

Limitation of liability

To the fullest extent permitted by law, total liability for any claim arising from the services is limited to the fees you paid in the three months immediately before the claim arose. Liability for indirect, incidental or consequential losses — including lost profit, lost revenue, lost data or business interruption — is excluded.

No liability is accepted for the acts, omissions, outages, policy changes, account suspensions or algorithm changes of third-party advertising platforms.

Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

Non-solicitation

During the engagement and for 6 months after, neither side will directly solicit the other's employees or contractors for employment without written consent.

Website use

You agree not to use this site unlawfully, attempt to gain unauthorised access, introduce malicious code, scrape content at scale, or interfere with its normal operation.

Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh. Both sides agree to attempt a good-faith resolution by discussion before starting proceedings.

Changes

These terms may be updated from time to time. The date at the top shows the current version. Continued use of the site after a change means you accept the updated terms.
